Supporters argue the change is a necessary clarification of constitutional intent, while critics warn it undermines a core principle of American identity and could have far-reaching legal and humanitarian consequences.

Originally ratified in 1868, the Fourteenth Amendment was crafted to secure citizenship for formerly enslaved people after the Civil War. The key phrase—“All persons born or naturalized in the United States, and subject to the jurisdiction thereof…”—has since been interpreted broadly by courts and lawmakers to confer birthright citizenship to nearly everyone born within U.S. borders.

The recent reinterpretation, however, hinges on a narrower reading of “jurisdiction,” suggesting that individuals born to certain categories of non-citizens—such as undocumented immigrants or temporary visitors—would no longer qualify for automatic citizenship. Legal experts say the outcome of this debate could significantly impact immigration law, civil rights, and national policy for generations to come.

As the issue makes its way through the courts, legal scholars, civil rights groups, and the public at large continue to closely follow developments, recognizing that the resolution of this debate could set a transformative precedent in U.S. constitutional history.
