Misuse of Autopen

The Department of Justice is investigating claims related to the use of a presidential autopen during the final days of the Biden administration. Ed Martin, the newly appointed pardon attorney and head of the DOJ’s Weaponization Working Group, confirmed the ongoing probe during an appearance on the “2WAY Tonight” program.

Martin stated that the investigation actually began while he was still serving as interim U.S. Attorney for the District of Columbia. According to Martin, the inquiry involves whether the autopen was used to issue presidential pardons without direct authorization from President Biden.

He also revealed that a whistleblower—identified only as a senior Democratic official with past involvement in the 2020 Biden campaign—came forward with allegations that certain individuals close to the president were acting as “gatekeepers” and may have financially benefited from controlling access to the pardon process.

Names Cited in the Investigation

According to Martin, five individuals were named by the whistleblower as having played central roles:

  • Ron Klain, former White House Chief of Staff
  • Anita Dunn, senior adviser to President Biden
  • Robert Bauer, former personal attorney to President Obama
  • Steve Ricchetti, former campaign chair and counselor to Biden
  • First Lady Jill Biden

Martin noted that Susan Rice and other figures were mentioned but not identified by the whistleblower as being directly involved.

Broader Concerns and Related Investigations

The investigation has emerged alongside broader questions raised by lawmakers and watchdog groups regarding presidential decision-making and document authorization during the Biden administration.

Concerns include:

  • Reports of President Biden’s signature appearing on official documents during his vacations
  • His own statements suggesting memory lapses regarding significant executive actions
  • Allegations from a former aide that a top staffer may have signed documents on Biden’s behalf

House Republicans, citing these concerns, are requesting interviews with Biden’s former physician and top White House aides. The House Oversight and Government Reform Committee has sent formal letters seeking transcribed testimony from former White House doctor Dr. Kevin O’Connor and four senior staff members.

Chairman James Comer stated the panel is evaluating legislation that would expand oversight of presidential fitness to serve.

President Biden has not publicly responded to the investigation. The DOJ and White House have not commented on the allegations. As of now, no criminal charges have been filed.
