Tensions have escalated between former Immigration and Customs Enforcement (ICE) official Tom Homan and Representative Alexandria Ocasio-Cortez following her recent town hall and webinar aimed at informing immigrants of their legal rights.
The webinar, titled “Know Your Rights With ICE,” was hosted on February 12 by Ocasio-Cortez and addressed common questions about what individuals should do during encounters with immigration enforcement. During the event, she explained that ICE agents are required to have a valid, judge-signed warrant to enter a home and emphasized that people have the right to request to see that documentation before opening the door.
Supporting materials on her official website echoed this advice, stating: “You do not have to open the door unless ICE has a judicial warrant.” The website also shared resources for accessing legal aid services.
Following the webinar, Homan criticized the guidance, arguing that encouraging people not to comply with federal removal orders could have legal implications. “There are laws that require individuals with final orders of removal to comply,” he said in a televised interview. “Interfering with enforcement actions may be subject to review.”
Ocasio-Cortez addressed the criticism during a town hall in Jackson Heights, Queens. “I’m using my free speech rights to inform people of their constitutional protections,” she said. “If someone believes that’s inappropriate, I’m not backing down.”
In a follow-up interview, Homan stated that enforcement operations would continue and that more ICE personnel would be deployed in major cities to identify individuals with final removal orders. He emphasized that these efforts would proceed regardless of local political support.
Department of Homeland Security Secretary Kristi Noem also commented on the situation, stating that the Department of Justice might review the circumstances surrounding public officials sharing legal guidance that intersects with federal enforcement operations.
The situation highlights the ongoing debate about immigration enforcement strategies and public education around civil rights. While some officials argue that such public guidance can hinder enforcement efforts, others maintain that individuals should be fully informed about their legal protections during interactions with law enforcement.
