Undocumented Immigrant’s Departure Highlights Legal Gaps in Employment and Immigration Policy

The recent case involving an undocumented immigrant who worked as a campaign aide has reignited public debate surrounding immigration policy, employment eligibility for non-citizens, and the role of DACA recipients in the workforce. The individual, originally from Ecuador, arrived in the U.S. at age seven in 2001 on a visitor’s visa, which was later overstayed. He eventually became a beneficiary of the Deferred Action for Childhood Arrivals (DACA) program, which offered temporary protection from deportation.

Deportation and Self-Exile: A Bittersweet Decision

In a surprising move, the former aide reportedly chose to self-deport to Colombia, calling the decision bittersweet. “It’s bittersweet. I hadn’t left the country in 23 years — from age seven to age 30,” he told Migrant Insider. His departure came after building a life in the U.S. through advocacy and political campaign work.

Describing the transition as surreal, he explained that living under the constant threat of deportation had taken a toll, and leaving the country provided a new sense of freedom. In Colombia, he has found a “freedom of movement” he never experienced as an undocumented immigrant in the U.S.

Employment Questions and Legal Concerns

While under DACA protection, the individual held a position as a deputy communications director for a 2021 political campaign. Although DACA allows for temporary legal employment, it prohibits paid roles within official congressional offices, raising questions about the legality of his employment arrangement.

His case has sparked broader scrutiny of how political campaigns and other employers handle the hiring of DACA recipients, particularly in roles closely associated with government functions. The situation underscores existing legal ambiguities regarding the employment of non-citizens and the responsibilities of organizations in adhering to federal employment laws.
