According to White House adviser Stephen Miller, the decision reaffirmed the executive branch’s control over immigration enforcement and foreign policy.

“The Court said that the most the government can be expected to do is facilitate return, meaning if El Salvador willingly sends him back, we won’t block him at the airport,” Miller said in a televised interview. “That doesn’t mean the U.S. has to force another country to return someone.”

Miller characterized the ruling as a clear legal victory, pushing back against media reports suggesting the government had been ordered to bring Abrego Garcia back. He emphasized that the original deportation followed an existing removal order issued in 2019.

Ongoing Questions and Conflicting Claims

While ICE and the Justice Department acknowledge procedural issues in the case, Miller disputed that the deportation was a mistake. He claimed that confusion originated from a now-former government lawyer who allegedly mischaracterized the situation in court filings.

“There is no dispute that this individual is from El Salvador, is here illegally, and has a final removal order,” Miller said. “There is no requirement to reverse that.”

Host Bill Hemmer of Fox News pressed Miller about whether the government still believed Abrego Garcia was connected to gang activity. Miller affirmed that officials remain convinced of his prior involvement with MS-13, though no formal criminal charges have been publicly disclosed.
